For Phoenix criminal defense clients · Preliminary hearing

Understand the purpose of a felony preliminary hearing and what can follow it.

Video transcript

Hi, I’m Dante Wright. If your felony case has a preliminary hearing, here is what that date means. It is not the trial, and the judge is not deciding whether you are guilty. The question is whether there is probable cause to move the felony charge forward. The Commonwealth may present witnesses and other evidence, and your attorney can test that evidence within the rules of this hearing. If the judge finds probable cause, the felony can move toward circuit court. If not, the charge may be dismissed at that hearing or reduced to a misdemeanor, depending on the evidence. Your attorney will explain the ruling and what happens next. Our office will confirm your hearing details and appearance instructions. Follow the directions we give you for your specific case.
