Injured as a Passenger in a Virginia Car Accident: Where to Start

When you are hurt as a passenger, you may have little information about the drivers’ insurance and no control over how they describe the crash. Start with medical care, your own record of what happened, and the details needed to identify each vehicle and claim. You do not have to adopt a driver’s account when you did not personally see what occurred.

Identify the drivers and the sequence of events

Save the date, location, police report number, driver names, vehicle information, and insurer contacts you receive. Note where you were sitting and what you saw, heard, or felt before each impact. If a friend or relative was driving, distinguish your observations from their later explanation.

A passenger’s claim may involve another driver, the driver of the occupied vehicle, or more than one person, depending on the evidence. Being a passenger does not establish which driver was negligent or guarantee compensation. An investigation should address responsibility for the collision and the connection between the crash and the injuries claimed.

You can request a crash report

The Virginia DMV lists passengers among the people eligible to receive a complete police crash report. Its official crash-report instructions explain the information, form, and payment required. Save a copy of the report and flag factual errors for your attorney; the report is one source of evidence, not a substitute for investigating disputed events.

More than one insurance policy may need review

  • Liability coverage: Identify the insurance for each potentially responsible driver or vehicle.
  • Uninsured or underinsured motorist coverage: The occupied vehicle’s policy and an applicable personal or household policy may matter.
  • Medical expense coverage: Ask whether purchased automobile medical expense benefits apply to you as an occupant.

Virginia’s UM/UIM statute includes guests in the insured vehicle within its definition of an insured and sets a payment order when multiple policies apply. Coverage still depends on the facts and policy terms. Our Virginia UM/UIM guide explains questions to raise when insurance is missing or insufficient.

Keep your injury information separate and complete

Maintain your own treatment timeline, medical bills, work restrictions, and missed-work records. Save communications addressed to you, even if a driver is also collecting documents. If several occupants are injured, their medical needs and insurance issues may differ.

Tell a prospective attorney who else was involved and whether anyone already has counsel. Shared representation is not automatic; the attorney must evaluate potential conflicts before agreeing to represent multiple people.

Review a proposed release before signing

Do not assume a payment resolves only one small part of the matter. Ask whose claims are being released, which parties are protected, and whether accepting payment could affect another available claim or coverage. Keep the entire proposed agreement for review.

General information. Responsibility, coverage, and representation depend on the circumstances of the individual claim.
